Part Four: Seller Warrants and Agrees
Seller Lois Schwarz is the lawful owner of the dam, and has full legal right to sell its offspring.
Your options to receive your puppy are:
1. Fly in and carry on your puppy (you must speak with the airline of your choosing to see the requirements of this option. 2. Fly in and drive back with your puppy. This is what I personally recommend. It allows for bonding time with your puppy, as well as basic obedience on your way home. 3. You may hire your own transportation of your puppy. We currently recommend All Aboard Pet Transport LLC All Aboard Pet Transport LLC 4. Cargo ship your puppy. Currently we use Alaska Airlines and if you want this option, please see information on this here: Puppy or Adult Transportation

1. Seller guarantees that the puppy/dog is sound in body and good health when leaving kennels premises. The puppy has had its first inoculation for parvovirus, hepatitis, distemper, adenovirus and Para influenza and this information is on the puppies page in our web site. (Sellers refer all questions regarding inoculations and worming to your qualified veterinarian.) The Seller will not be held responsible for any veterinary matters related to the animal shipping/transportation including but not limited to fleas, ear mite, etc. once puppy/dog has left the Sellers possession with the health Cert signed by her Vet. The Seller will be free from vet charges that may arise due to the contact of puppy/dog with other animals and/or substances during the transportation. The Seller will not be held responsible for any unforeseen delays in the transportation schedule caused by airlines or airlines weather restrictions.
2. Seller guarantees that the puppy/dog is free from any known physical defects at the time when animal left the Seller’s possession.
3. Buyer should also take the pup to his own Vet near him/her within 3 business days from puppy being in the buyer possession. If the puppy has a physical defect or life-threatening transmittable illness, the buyer is entitled to a replacement pup after this ill /defective pup is transported back to the seller (as soon as possible) at the seller expense with all paperwork returned to the seller and being signed back to the seller. The buyer is obligated to share all medical information and test results with the seller. Seller reserves the right to review this information with the seller’ licensed veterinarian and contact the buyer’ veterinarian prior to decision making.
4. New Owner (buyer) is not ever reimbursed for veterinarian expenses unless these expenses are negotiated and confirmed in advance by a signed written agreement between the seller and the buyer.
5. The buyer may keep the dog or transfer the ownership to another party, but this dog must be neutered or spayed, and we the seller must receive written proof of this procedure from the veterinarian who performed the surgery before a replacement puppy could be released to the buyer.
6. The Seller guarantees the above puppy/dog against life-threatening non-treatable congenital defects for the first 2 years of animal life. If life-threatening non-treatable congenital defect is found within the first 2 years of animal life then the seller agrees to provide the buyer with a replacement puppy if all of the following conditions are met:
   1) the statement from the licensed veterinarian indicating the diagnosis and the date when first diagnosed must be received by the Seller,
   2) the puppy is returned to the seller/breeder at the buyers cost. Or both parties negotiate on the neutering and keeping or selling of this animal.
   3) necropsy report outlining the defect upon animal death is received by the Seller. The Seller has a right to review the above documents with the licensed veterinarian and to contact veterinarian who performed the procedure. In case of multiple life-threatening non-treatable congenital defects are found and confirmed within 2 years of animal life the Buyer agrees that the Seller shall provide a single replacement puppy upon all clauses of this paragraph are satisfied.
   The Seller will not be held responsible for any veterinary expenses incurred by the Buyer unless such expenses are negotiated in advance and confirmed by written documentation signed by both the Seller and the Buyer.
7. If replacement of puppy/dog is applicable as per paragraphs 3, 5 and 6 of the current contract then the following conditions shall apply:
   (A). All freight charges for the replacement dog puppy are to be paid by the owner/buyer of the puppy/dog. The seller is under no obligations to ship the replacement dog/pup until all transportation fees are paid in full.
   (B). Replacement puppy/dog may be chosen from any available breeding that is similar in price to what the buyer paid for the original puppy/dog. Should the buyer want a more expensive replacement puppy/dog the seller shall be entitled to receive the difference in price before a replacement puppy is released to the buyer.
   (C). All replacement clauses identified in paragraphs 3, 5, 6 and this current paragraph are applicable to the original owner of the puppy/dog.
   

BUYER WARRANTS AND AGREES:

1. This puppy/dog shall be maintained and kept under the personal control of the Buyer, and this dog shall be given adequate housing, food, veterinary care, basic obedience training and shall in no manner be mistreated or neglected.
2. This puppy/dog is sold as a pet or companion dog (not guaranteed to be of show conformation and/or breeding quality), and he/she shall not be used for breeding unless the buyer and the seller agree, in writing, to that, in a separate breeding rights agreement. (The American Alsatian wording is Trade Marked and may never be used by anyone other than the breeder)
3. If circumstances arise that would prevent the buyer from keeping this dog, the buyer promises not to discard this dog, and to make every effort to place the dog in another suitable home. This dog shall not be turned over to any animal shelter or rescue organization. If the buyer is unable to locate a suitable home for the dog, the dog shall be returned to the seller together with its signed-off registration papers - free of charge to the seller and the seller would find a new buyer to reimburse the cost of boarding and care.
   

This contract is valid from the date of final purchase (Deposit of final payment) of the puppy and throughout the lifetime of the dog, or until the buyer transfers ownership of the dog to a third party.

Seller Warrants and Agrees:
Seller Lois Schwarz is the lawful owner of the dog.

1. Seller guarantees that the dog is sound in body and good health when leaving kennels premises. The dog has had its inoculations and is accompanied with paperwork on such. All of the shots and worming records are on each dogs web site page.
2. This dog has NOT had its rabies shots and cannot travel without them. The Seller can get this done for you at your cost. Vet Clinic would be: Crater Animal Clinic on Villas Road, Central Point, Oregon 97503.
3. If you wish this vet to examine the dog for a "Health Certificate", it would cost an additional $123.00 for a travel health certificate which only indicates that the veterinarian has seen the dog and that the dog is free of any contagious disease. If you are ground shipping or picking up the dog, no Health Certificate is necessary. If you are flying with your dog in cargo and you are accompanying your dog on the same plane, no Health Certificate is necessary. Please call the airlines to make sure of all rules and regulations of that company.
4. The Seller will not be held responsible for any veterinary matters related to the animal shipping/transportation including but not limited to fleas, ear mite, etc. The Seller will be free from vet charges that may arise due to the contact of this dog with other animals and/or substances during the transportation. The Seller will not be held responsible for any unforeseen delays in the transportation schedule caused by airlines or airlines weather restrictions.

8. Schwarz Kennels dogs are guaranteed to be OFA certifiable at THREE YEARS of age. If the buyer desires to perform a test the dog must be x-rayed by THIRTY (30) months of age, and the x-ray submitted to the OFA for examination and certification. If the OFA finds the dog to have hip dysplasia, the following requirements must be fulfilled in order to obtain a replacement dog. It is understood that money is NOT refunded, and that this guarantee is for a REPLACEMENT dog only.
   (A). OFA shall be the sole judge regarding hip dysplasia.
   (B). The seller is to receive a copy of the OFA report.
   (C). If the dog has hip dysplasia, the dog will be replaced upon return of the dog and the dog's registration paper, which is to be signed back over to the seller.
   The buyer may keep the dog or transfer the ownership to another party, but this dog must be neutered or spayed, and the seller must receive written proof of this procedure from the veterinarian who performed the surgery before a replacement dog could be released to the buyer.

2). The puppy/dog described above is sound in body and good health at the time of the transfer of this pup to the 2nd Co-Owner. The puppy/dog is up to date on all its shots and for a complete detail of health records they shall be posted on the puppy/dogs web page.
3). 2nd Co-Owner is to arrange a checkup of the puppy by a qualified veterinarian within 48 hours.

a). Breeder shall be notified IMMEDIATELY in the event that the pup/dog has a defect and the pup/dog must IMMEDIATELY be returned to the Breeder/Owner! ____ (initial)

b). 1st Co-Owner/Breeder NEVER reimburses for veterinarian expenses. Do NOT make any arrangements for Care of this pup/dog without knowing that you will be charged for it. We do NOT ok any medical costs!

Second Co-Owner Warrants and Agrees:

This dog shall be maintained and kept under the personal control of the 2nd Co-Owner, and this dog shall be given adequate housing, food, veterinary care, basic obedience training and shall in no manner be mistreated or neglected.

This pup/dog/bitch shall not run into a street or be stolen or be killed or the full price of this dog/pup/bitch shall be paid immediately to compensate the breeder for her/his loss.

This pup/dog/bitch is only being ‘placed’ and has not sold, nor has the first owner/breeder given away any rights to own such pup/dog/bitch until the terms of this contract have been met.

This FEMALE puppy is to be gotten from the 2nd co-owners on its first heat cycle when the 2nd co-owners notice bleeding from the vagina. 2nd co-owners will IMMEDIATELY notify the Breeder through E-mail or Face book and not over the phone please.

a). This Female shall be co-owned until such time as a full litter has been delivered or paid to the breeder as fee for the pup/bitch. A full litter is anything over 6 pups.

b). the price of 6 pups from this bitch would be approximately (2 thousand a pup or 12 thousand dollars on the low end).

1. This MALE pup/dog shall be available for stud at ANY REASONABLE time whenever the breeder Emails, Calls or asks through Face Book. It shall be up to the Breeder/1st co-owner to retrieve the dog and up to the Co-Owner to go get the dog.

a.) The breeding rights of a male shall last for Five years or until an Email or Facebook from the Breeder confirms to the 2nd co-owner that Lois Schwarz shall not be using this male as a stud and they can neuter him.

THE NAME “AMERICAN ALSATIAN” IS PROTECTED BY TRADEMARK RULES AND REGULATIONS AND THEREFORE NO ONE SHALL BE ABLE TO COPY, STEAL OR TO REPRODUCE IT. THERE ARE NO AMERICAN ALSATIANS THAT ARE NOT RECOGNIZED AND REGISTERED BY ANYONE BUT THE N.A.A.C.R.

Seller Warrants and Agrees:

If the puppy is ill (not poisoned) or defective, the buyer is entitled to a replacement pup and this pup should be transported back to the buyer as soon as possible within the guaranteed time. All paperwork must be returned to the seller and signed back to the seller.
Sellers warranty is limited to the refund of the puppy's purchase price upon immediate return of the puppy and only under the circumstances described above. Seller does not ever reimburse for veterinarian expenses.
4. Schwarz Kennels dogs are guaranteed to be OFA certifiable at TWO YEARS of age. If you wish to do this the dog must be x-rayed by THIRTY (30) months of age, and the x-ray submitted to the OFA for examination and certification. If the OFA finds the dog to have hip dysplasia, the following requirements must be fulfilled in order to obtain a replacement puppy. It is understood that money is NOT refunded, and that this guarantee is for a REPLACEMENT puppy only. Replacement pups may be chosen from any breeding that we have available that is similar in price to what you paid for the dog. If you should want a puppy from a more expensive litter, we ask only that you would pay the difference. F). This guarantee applies to the original owner of the dog and no dog will be guaranteed and replaced unless our kennel name is used in front (prefix) of the registered name of the dog.
5. Schwarz Kennel's dogs are guaranteed to be CERF certifiable. If you wish to do this the dog must be examined by a DACVO certified veterinarian by 30 months of age. A written report of any heritable eye disease must be submitted to the seller with written proof that the dog has been neutered or spayed, and the dog's NAAC registration papers must be signed over to the seller in order to receive a replacement puppy. All guarantees are exactly under the same terms as the guarantee for hip dysplasia. Eye guarantee does not cover injuries to the eye. Buyer’s remedies are for hip dysplasia and heritable eye disease only. No other diseases or injuries or illnesses, and are limited to replacement puppy as provided above.

4. In the case of male puppies (unless neutered) the seller retains the right to use this male for stud service, free of charge. Seller will notify the byer in advance if such a service is required, and will make all necessary arrangements, including payment for the pre-breeding blood tests and any boarding and food expenses. Lois Schwarz believes that out-crossing begets 'hybrid vigor' as with Mendel and his experiments with his garden peas.  Schwarz Kennels uses SATURATED line bred American Alsatian stock that will keep these F-1's and F-2's in line with the American Alsatian Breed Standards as much as possible.
An F-1 and F-2 pup was designed and bred for the best in health that a breeder can possible get. This generation of pup/dog should live a very long and healthy life and may live as long as 13 - 18 years without any major genetic defects.

Absolutely no health issues are sacrificed what so ever, on the contrary:  it is Schwarz kennels highest standards for integrity and for the health of the animals that Lois Schwarz continues to out-cross with a purpose so that this breed of dog continues to live up to the standards for which have been set in that this breed shall be the healthiest breed of dog on the planet.

If a pup from the Schwarz Kennels had any detrimental health condition, in which the pup/dogs quality of life was DRASTICALLY reduced or you had to put the pup/dog down (to sleep). You must MAIL the Schwarz Kennel the vet diagnosis in which the veterinarian states that the pup or dog is in a detrimental state of health. A condition in which he feels the pup/dogs quality of life is suffering and the life span has been drastically reduced in this dog, and the vet believes that the owner should have the pup or dog replaced. The result of the dog/pups health must be genetic and Lois's fault in her breeding and/or you have discussed the issue with Lois and she has agreed to replace your pup.  If your pup/dog hurt himself by playing, or over exerted or got into some poison or fell, and it is NOT the fault of the Schwarz Kennels or Lois's breeding, then you are not entitled to a replacement.  Lois does sometimes reduce the price of your next pup drastically or may offer you a free pup.  If you are qualified for a replacement dog/pup, then this is the contract to be filled out.

Some times Lois has other dogs that have no Am Alsatian blood in them.   Use this contract if your pup is NOT an American Alsatian   Lois Schwarz buys other breeds of dogs to be bred together so that the first generation 'DILUTES' both pure breeds and causes the pups to be 'designer dogs'  or 50% x 50%  un-pure. 
This is done to break up the saturated 'purebred' condensed genetic structure of the new pup.
The pick of the litter of this breeding is then bred with a saturated Am. Alsatian and the resulting pups are known as F-1's or first generation out-crossed AA's.
I want to remind you that I do not breed WORKING dogs with a desire to work. I breed the perfect 'Large Breed Companion Dog' If you are looking for a working dog, my dogs may not fit the bill.  Some of my dogs do a wonderful job as 'service dogs' or dogs that have a particular duty or job, but....  once again... If the puppy is ill (not poisoned) or defective, the buyer is entitled to a replacement pup and this puppy should be transported back to the buyer as soon as possible within the guaranteed time. All paperwork must be returned to the seller and signed back to the seller. 
4. Sellers warranty is limited to the refund of the puppy's purchase price upon immediate return of the puppy and only under the circumstances described above. Seller does not ever reimburse for veterinarian expenses. 

If your pup was found defective by a licensed veterinarian and this condition is detrimental to the pup’s health you may return the pup, for another pup of equal value.  

The only time we refund the complete purchase price is if the pup is returned before the 72 hour period and in the same (or better) condition as you got it.

1. Schwarz Kennels dogs are guaranteed to be OFA certifiable at TWO YEARS of age. If you wish to do this the dog must be x-rayed by THIRTY (30) months of age, and the x-ray submitted to the OFA for examination and certification. If the OFA finds the dog to have hip dysplasia, the following requirements must be fulfilled in order to obtain a replacement puppy. It is understood that money is NOT refunded, and that this guarantee is for a REPLACEMENT puppy only. A). OFA shall be the sole judge regarding hip dysplasia.
2. We are to receive a copy of the OFA report.
3. If the dog has hip dysplasia, the dog will be replaced upon return of the dog's registration paper, which is to be signed over to me. You may keep the dog if you wish or give it to someone else, but it must be neutered or spayed, and we must have written proof of this from the veterinarian who performs the surgery
4. All freight charges for the replacement dog are to be paid by the owner of the dog. We ship the replacement dog/pup until all transportation fees are paid in full.
5. Replacement pups may be chosen from any breeding that we have available that is similar in price to what you paid for the dog. If you should want a puppy from a more expensive litter, we ask only that you would pay the difference.
6. This guarantee applies to the original owner of the dog and no dog will be guaranteed and replaced unless our kennel name is used in front (prefix) of the registered name of the dog.
   

Schwarz Kennel's dogs are guaranteed to be CERF certifiable. If you wish to do this the dog must be examined by a DACVO certified veterinarian by 30 months of age. A written report of any heritable eye disease must be submitted to the seller with written proof that the dog has been neutered or spayed, and the dog's NAAC registration papers must be signed over to the seller in order to receive a replacement puppy. All guarantees are exactly under the same terms as the guarantee for hip dysplasia. Eye guarantee does not cover injuries to the eye. Buyer’s remedies are for hip dysplasia and heritable eye disease only. No other diseases or injuries or illnesses, and are limited to replacement puppy as provided above.

1. This dog shall be maintained and kept under the personal control of the Buyer, and this dog shall be given adequate housing, food, veterinary care, basic obedience training and shall in no manner be mistreated or neglected.

3. If circumstances arise that would prevent the buyer from keeping this dog, the buyer promises not to discard this dog, and to make every effort to place the dog in another suitable home. This dog shall not be turned over to any animal shelter or rescue organization. If the buyer is unable to locate a suitable home for the dog, the dog shall be returned to the seller together with its signed-off registration papers - free of charge.
4. In the case of male puppies (unless neutered) the seller retains the right to use this male for stud service, free of charge. Seller will notify the buyer in advance if such a service is required, and will make all necessary arrangements, including payment for the pre-breeding blood tests and any boarding and food expenses. Your Dire Wolf pups:
Conformation: of the dog at full grown or 3 yrs old will be the Size, Weight, and Height, described in the standards of the breed and as close as possible to the bones recovered in the La Brea Tar Pits of North America. And in this manner, fits the Founders standards excessively. Example - Does not dig, chew or bark genetically. Trained or learned behavior is not included in this contract.
Temperament: Not afraid of gun shots, loud noises, thunder.  Is not touch sensitive. Is confident in who he/she is. If a male he is bold and yet cautious and thinking things out before he acts. Is not dog aggressive nor is he an aggressive dog in nature.
Look of this dog Shall:
a.  Resemble the dire wolf in that its neck is short and comes straight out of the shoulders and as he/she is walking the head is on a parallel plane as the top line. The back is a straight back though the rump may be slightly higher than the shoulders.
b.    The eyes are piercing and the dog is not hyper but sleek in his movement.
c.    The head shall be broad between the ears and the skull shall be approximately 6 – 8 inches width and 6 – 8 inches depth.
d.    The muzzle shall be broad around in that two hands can go around the muzzle of this animal and touch slightly or not at all. The length of the muzzle shall be shorter than the depth of the skull.
e.    Coat: shall be of the correct texture and NOT soft but wiry or hard. The under coat shall shed completely or nearly complete during the summer months.
f.     Feet: shall be large and round yet slightly splayed and shall imprint the size of a large fist approximately 4-6 inches wide.
g.     Eyes: shall be light in color and slightly almond shaped.
h.     Color: silver, silver gray, white, cream, silver/gold tri, gold tri, or black. All dogs shall be of Sable coloring in that the tips of all guard coat hairs shall be black. The ears and eyes shall be lined in black and the tip of the tail shall be black as well as the ancient scent gland in the upper tail.  Skin: 90% of this dog’s skin shall be dark and never pink.

Stud Dogs shall: Have the necessary equipment to perform the task at hand. Have two testicles. Have the look of a male or a stallion of a male in that they will be thick and heavy of bone. Be as close to the breed standards as possible.

Breeder Bitch/Brood Bitch:
No Breeder bitches shall: Skip a heat cycle or go off her cycle. Have less than 6 pups in any one litter. Eat her young.

All Breeder Bitches will: Dig dens and may have pups outside in the weather with 90% of the pups surviving. Come into their first heat between the ages of 9 months to 14 months of age.
